Terms and Conditions of Use and Accommodation Agreement

Terms of Use

Please comply with the terms and conditions of this agreement.
If the guest fails to comply with the above conditions, we may have no choice but to refuse the stay and use of the hotel’s facilities in accordance with Article 7 of the Accommodation Clauses.In the event of an accident caused by the customer’s intention or negligence, the customer may be held liable for damages.

Items to be observed for fire prevention

1. Please refrain from bringing in or using fire or irons for heating or cooking in the hotel.

2. All rooms in the hotel are non-smoking. Smoking is allowed in the smoking room on the 2nd floor.

3. Do not touch fire fighting equipment, etc. except in case of emergency.

4. Please check the evacuation route map and emergency exits on each floor immediately after check-in.

Items to be observed for security purposes

1. During your stay, please make sure the door is locked when you leave your room.

2. When you have a visitor, please do not carelessly open the door. If you suspect a suspicious person, please contact the front desk immediately.

3. Please meet with visitors on the first and second floors.

4. Accommodation of guests other than those registered to stay at the hotel is strictly prohibited.

About room key

1. Please make sure the door is locked when you leave the room.

2. Please make sure to lock the door when you are in the room and when you go to bed.

3. Please be sure to return your room key or the key to the front desk when you leave the hotel. If the key is not returned due to loss, you will be charged the actual cost of the key.

Handling of Valuables and Checked-in Items

4. The hotel will not be responsible for any loss or theft of cash or valuables during your stay.

5. Lost and found items will be kept at the hotel for 90 days for cash and valuables and 14 days for other daily necessities from the date of discovery, after which they will be handled in accordance with the Lost and Found Law.

6. Upon arrival, guests’ baggage will be temporarily stored at the front desk. Please note that cash, valuables, and food are not accepted. Please understand this.

About Payment

1. Upon arrival, the hotel reserves the right to charge a deposit as determined by the hotel. Please understand this.

During your stay, you will be billed for payment by the hotel.

2. Please note that we do not accept checks or exchange money.

3. We will not be able to replace airline tickets, bus or train tickets, cab fares, postage stamps, or baggage transportation.

Actions that we ask you to refrain from

1. Please do not engage in any of the following activities, as they may disturb other guests

① Please do not bring any items into our hotel that may disturb other guests.

> Dogs, cats, birds, and all other animal pets. (However, this does not apply to guide dogs, hearing dogs, nursing dogs, etc.)

> Items that produce foul or unusual odors.

> Hazardous materials such as explosives and volatile oils that can easily ignite or catch fire.

> Other items whose possession is prohibited by law.

> Potential to stain common areas and fixtures, e.g., wet or dirty items.

② Please do not deliver food from outside to our hotel.

③ Please refrain from shouting, singing, or any other boisterous behavior that may disturb other guests in the hotel.

④ Please do not use the guest rooms for any purpose other than lodging, eating and drinking without the permission of the hotel.

⑤ Please do not engage in gambling or any other activities that may disturb public morals in the hotel.

⑥ Please do not move any of the facilities or items in the hotel to another location or otherwise alter their current state without the hotel’s permission.

⑦ Please do not display anything in the window that detracts from the appearance of the hotel.

⑧ Do not leave personal belongings such as laundry, umbrellas, shoes, etc. outside of guest rooms (common areas including hallways).

⑨ We strictly forbid anyone other than registered guests to stay in your room. Please do not invite guests from outside to stay in your room.

⑩ Please do not distribute or post advertising materials or solicit sales of goods in the hotel or on the surrounding streets without our permission.

⑪ Please note that public use of photographs taken in the museum for business purposes without permission may result in legal action.

⑫ Please do not go out in the hallways or outside in pajamas, slippers, etc.

⑬ Please do not take any equipment from the facility home with you.

⑭ Smoking outside of designated areas is strictly prohibited.

2. If a guest fails to immediately cease his/her conduct after receiving a warning from the hotel regarding the “conduct we request you to refrain from” in the preceding paragraph, the guest will be denied use of the hotel’s facilities.In such cases, no refunds will be made under any circumstances.

Prohibition of use of facilities by antisocial forces, etc.

1. The following organizations and individuals are not permitted to use the hotel’s facilities.

① 暴力団、暴力団員、暴力団関係団体及びその関係者

crime syndicate, crime syndicate-members, Organizations affiliated with organized crime groups and their affiliates

② Persons affiliated with crime syndicate or corporations or other organizations whose business activities are controlled by gangster

③ Antisocial organizations, members of antisocial organizations, and related persons

④ In cases where assault, injury, threats, extortion, coercive unreasonable demands, and similar acts are recognized.

⑤ Persons who are unable to ensure their own safety due to mental or emotional exhaustion, loss of self due to drugs, etc., or who may pose a danger, fear, or anxiety to other customers.

2. In the event that any of the above items ① through ③ applies to you, you will be prohibited from using the service at that time and thereafter.

accommodation clause

Article 1.

1.The accommodation contract and related agreements entered into by HOWE HOTEL (hereinafter referred to as “this hotel”) with a guest shall be in accordance with the provisions of these general terms and conditions, and any matters not provided for in these general terms and conditions shall be in accordance with laws and regulations or generally established customs.

2. In the event that the Hotel agrees to a special agreement that is not contrary to law or custom, such special agreement shall prevail notwithstanding the provisions of the preceding paragraph.

Article 2.

1. A person who wishes to apply for a contract of accommodation at this hotel shall provide the following information to this hotel.

①Guest Name

② Date of stay and estimated time of arrival

③ Accommodation charge (as a general rule, based on the basic accommodation charge in Appendix 1)

④ Other matters deemed necessary by the hotel

2. In the event that a guest requests to continue his/her stay beyond the date of stay stipulated in item 2 of the preceding paragraph during his/her stay, this hotel shall treat such request as a new application for a contract of stay at the time such request is made.

Article 3.

1. The accommodation contract shall be concluded when this hotel has accepted the application as described in the preceding article. However, this shall not apply when this hotel proves that it has not given its consent.

2. When an accommodation contract has been concluded pursuant to the provisions of the preceding paragraph, the full amount shall be paid by the date designated by this hotel.

3. In the event that the amount specified in the preceding paragraph is not paid by the date designated by this hotel, the accommodation contract shall cease to be effective.However, this shall be limited to cases where this hotel has notified the guest to that effect when specifying the due date for payment.

Article 4.

1. Notwithstanding the provisions of Paragraph 2 of the preceding article, the hotel may accept a special agreement that does not require the payment of the application fee as set forth in the same paragraph after the contract is concluded.

2. In the event that this hotel, in accepting an application for an accommodation contract, does not request payment of the deposit as stipulated in Paragraph 2 of the preceding article or does not specify the date of payment of said deposit, it shall be deemed to have complied with the special provisions of the preceding paragraph.

Article 5.

1. This hotel may refuse to conclude an accommodation contract in the following cases.

① When an application for accommodation is not in accordance with these terms and conditions.

② When there is no room available due to full occupancy or congestion.

③ When it is recognized that the person who intends to stay at the hotel is likely to commit an act contrary to the provisions of laws and regulations, public order, or good morals in connection with the stay.

④ When the person seeking accommodation is a crime syndicate, a member of a crime syndicate, a group affiliated with a crime syndicate, or a person related to a crime syndicate, or any other anti-social force.

⑤ When the person seeking accommodation is a crime syndicate or a juridical person or other organization whose business activities are controlled by a crime syndicate member.

⑥ When the person seeking accommodation is a juridical person and one of its officers falls under the category of a crime syndicate member.

⑦ When a person who intends to stay at the hotel commits a violent act of demand against the hotel or its employees, or demands a burden exceeding a reasonable range.

⑧ When it is clearly recognized that the person who intends to stay is a person infected with a contagious disease.

⑨ When it is impossible to accommodate guests due to natural disasters, breakdown of facilities, or other unavoidable reasons.

⑩ When a person who intends to stay at the hotel is likely to cause inconvenience to other guests due to intoxication, etc.When there is language or behavior that is extremely disturbing to other guests.(When it falls under Article 9 of the Toyama Prefecture Ryokan Law Enforcement Ordinance.)

Article 6.

1. The guest may cancel the accommodation contract by making a request to this hotel.

2. In the event that a guest cancels all or part of the accommodation contract due to reasons attributable to the guest, this hotel shall charge a penalty fee in accordance with the provisions of Appended Table 2.However, in the event that this hotel accepts the special contract stipulated in Article 4, Paragraph 1, it is limited to the case where this hotel has notified the guest of the obligation to pay a penalty when the guest cancels the accommodation contract in accepting the special contract.

3. In the event that the guest has not arrived by 8:30 p.m. on the day of the stay, this hotel shall deem the accommodation contract to have been cancelled by the guest and shall charge a penalty fee in accordance with the provisions listed in Appendix 2.

Article 7.

1. In the following cases, this hotel may cancel the accommodation contract regardless of the intention of the guest.

① When it is recognized that the guest is likely to commit an act contrary to the provisions of the law, public order, or good morals in connection with his/her stay, or when it is recognized that the guest has committed such an act.

② When it is clearly recognized that the guest is a person infected with a contagious disease.

③ When it is impossible to accommodate guests due to force majeure such as natural disasters.

④  If the applicant is a crime syndicate, a member of a crime syndicate, a group affiliated with a crime syndicate, or a person related to a crime syndicate, or any other anti-social force.

⑤ 暴力団又は暴力団員が事業活動を支配する法人、その他の団体であるとき。

When the applicant is a crime syndicate or a juridical person or other organization whose business activities are controlled by crime syndicate or crime syndicate member.

⑥ When a juridical person has an officer who falls under the category of a crime syndicate member.

⑦ When a guest makes a violent demand or demands a burden beyond a reasonable range from this hotel or its employees.

⑪ When a guest is likely to cause inconvenience to other guests due to intoxication, etc. When there is language or behavior that is extremely disturbing to other guests.(When it falls under Article 9 of the Toyama Prefecture Ryokan Law Enforcement Ordinance.)

⑧Smoking outside of designated areas, tampering with firefighting equipment, etc., or failure to comply with other prohibitions in the hotel’s rules of use (limited to those necessary for fire prevention).

2. When this hotel cancels the accommodation contract pursuant to the provisions of the preceding paragraph, no charge shall be made for accommodation services, etc. that have not yet been provided to the guest.

Article 8.

1. Guests shall register the following items at the front desk of this hotel on the day of their stay.

① Name, age, gender, address and occupation of the guest

② In the case of a foreign national, nationality, passport number, place of entry and date of entry

③ Departure date and scheduled departure time

④ Other matters deemed necessary by the hotel

Article 9.

1. Guests may use the hotel’s guest rooms from 16:00 until 10:00 of the following day.However, in the case of consecutive nights, the room may be used for the entire day except for the day of arrival and the day of departure.

2. Notwithstanding the provisions of the preceding paragraph, the Hotel may accept the use of rooms outside the hours specified in the said paragraph.In such cases, the following additional fees shall be charged.

① early check-in…1,000 yen per one-hour extension (check-in available from 14:00)

② late check-out…1,000 yen per hour extension (check-out available until 12:00 p.m.)

③ Check-out after 1:00 p.m. is equivalent to the room charge for the same day.

Article 10.

1. Guests shall abide by the terms and conditions of use established by the hotel and posted in the hotel while in the hotel.

Article 11.

1. The breakdown of accommodation charges, etc. to be paid by guests and the method of calculation thereof shall be as shown in Appended Table 1.

2. Payment of the room charge, etc. as set forth in the preceding paragraph shall be made in a method determined by this hotel.

3. Room charges shall apply even if the guest voluntarily does not stay at the hotel after the hotel has provided a room to the guest and made it available for his/her use.

Article 12.

1. When this hotel is unable to provide a guest with a contracted room, this hotel will, with the consent of the guest, mediate other accommodations with the same conditions as far as possible.

Article 13.

1. The hotel will not compensate for any damage caused by items brought into the hotel by guests.However, only in the case that a guest’s baggage is lost or damaged due to the hotel’s negligence, despite the hotel’s prior consent to store the guest’s baggage, the hotel shall compensate for the damage up to twice the room charge.

Article 14.

1. In the event that a guest’s baggage arrives at this hotel prior to his/her stay, it shall be stored responsibly only if this hotel understands this prior to the arrival and shall be handed over to the guest when he/she checks in at the front desk.

2. In the event that a guest’s baggage or personal belongings are left at this hotel after the guest has checked out, when the owner of such baggage or personal belongings is identified, this hotel shall contact the owner and request instructions from him or her.However, in the absence of owner’s instructions or when the owner cannot be identified, as a general rule, cash and valuables shall be kept for 90 days including the day of discovery, and other daily necessities for 14 days, after which they shall be delivered to the nearest police station.

Article 15.

1. When a guest uses the parking lot of this hotel, regardless of whether or not the key of the vehicle is deposited, this hotel rents a space and is not responsible for the management of the vehicle under any circumstances. However, the Hotel shall be liable to compensate for any damage caused by its willful misconduct or negligence in managing the parking lot.

Article 16.

1. In the event that this hotel suffers damages due to the intentional or negligent act of a guest, said guest shall compensate this hotel in full for such damages and lost earnings.

2. As all of the hotel’s facilities (except for designated smoking areas) are non-smoking, if smoking is confirmed in a guest room or facility, a penalty fee will be charged as listed in Appendix 2 as compensation for cancellation of the accommodation contract, room cleaning fees due to smoking, and for damages from the suspension of room sales.

Article 17.

1. Guests shall be responsible for their own use of Internet communications from within the hotel.The Hotel shall not be liable for any loss or damage incurred by the user as a result of service interruption due to system failure or any other reason during the use of computer communications.In addition, if any damage is caused to the Hotel or a third party as a result of an act that the Hotel deems inappropriate for the use of computer communications, the Hotel shall compensate the third party for such damage.

2. For special plans, there may be changes to the date and time of penalty accrual.
